Contractor Profile Display Consent

October 12 clarification: Profiles are private by default, except where the candidate has separately opted into public website promotion. This client-facing consent does not itself authorize public website promotion.

October 5 update: This version adds the Consent and Data Retention Standard, including separate marketing choices and evidence, record retention, legal holds, secure disposal and historical agreement acceptance. Publication does not amend a previously accepted agreement; material changes follow the applicable notice, consent and amendment procedures.

1. Controller

The personal information controller for this profile-display activity is VirtuPinoy Virtual Assistance Services, doing business as VirtuPinoy, at Pulong Santa Cruz, Santa Rosa City, Laguna 4026, Philippines.

2. Purpose

I give specific consent to VirtuPinoy’s collection, review, organization, and disclosure of the selected categories of my professional information to approved business clients and authorized service providers for candidate evaluation, matching, interview coordination, and potential engagement.

• evaluate my qualifications and work readiness;
• compare me with legitimate job requirements;
• view match scores and explanations;
• shortlist me;
• request additional information or an interview;
• select me for a potential engagement.

I understand that consent does not guarantee publication, presentation, interview, selection, contract, assignment, or income.

3. Information I Authorize for Client Display

Subject to my submission and VirtuPinoy review, I may authorize specific categories of my professional information for client display through the VirtuPinoy profile consent workflow. The categories available for selection include:

Core professional profile

• Professional photo
• Approved display name
• Professional title
• Professional summary
• Primary and secondary skills
• Years and areas of experience
• Industry experience
• Software, tools, systems, and platforms
• Education
• Certifications and training
• Languages and communication proficiency
• Relevant work history, responsibilities, and achievements
• Availability, time zone, preferred schedule, and start date
• Full-time, part-time, project, or other availability
• Equipment, internet, backup internet, and backup power readiness
• Interview availability
• VirtuPinoy verification indicators
• Profile last-updated date

Documents and media

• Resume or professional curriculum vitae
• Portfolio or approved work samples
• Introductory video
• Approved certification images or files
• Other professional information specifically identified to me at the time of consent

Commercial information

• Approved rate or rate range, if VirtuPinoy chooses to show it
• Availability status
• Engagement type preference

My actual selections recorded in the VirtuPinoy consent workflow determine the categories I authorize for standard client-facing display; this public list by itself does not record consent.

Separately, if I submit an application to a particular job through the portal, relevant information that I provide for that application will be shared with the client responsible for the job so it can evaluate the application and coordinate an interview. This may occur even if I do not have a published contractor profile. The Privacy Policy explains this application processing. Applying to a job does not by itself authorize general publication of my profile or subscribe me to optional marketing.

I understand that VirtuPinoy may decide not to display a selected category where it is unnecessary, unsafe, unverified, outdated, inconsistent with platform standards, or restricted by a Client or legal requirement.

4. Information That Will Not Be Displayed as Part of the Standard Profile

VirtuPinoy will not intentionally show the following on the standard client-facing profile:

• home address;
• date of birth;
• government identification numbers or images;
• tax identifiers;
• personal banking or payout details;
• emergency contacts;
• private personal email or phone number;
• medical or accommodation information;
• background-check source documents;
• internal staff notes, investigation records, or private references;
• passwords, verification codes, or security information;
• information about another applicant, contractor, or client.

Specific private information may be disclosed later only where lawfully necessary for a confirmed engagement, under a separate process and appropriate notice or authorization.

5. Who May See the Profile

VirtuPinoy may display the approved profile to:

• approved prospective clients and their authorized hiring representatives;
• authorized VirtuPinoy staff and service providers supporting recruitment, security, hosting, matching, or profile administration;
• professional advisers or authorities where required by law.

Profiles are private by default, except where the candidate has separately opted into public website promotion. This consent covers approved client-facing display; it does not itself authorize publication on the open internet. A separate, specific opt-in is required for public website promotion and covers only the approved professional information identified in that choice. Public promotional content may be viewed by anyone and indexed by search engines. Full resumes, private contact details, identity documents, financial information and internal records remain private and are not included in public promotional profiles.

I may withdraw a separate public website promotion choice or request removal of content controlled by VirtuPinoy by contacting privacy@virtupinoy.com. Search engines or other third parties may retain copies outside VirtuPinoy's control. Account creation, applying for a job, client-facing profile approval and newsletter consent do not by themselves authorize public website promotion.

VirtuPinoy will use reasonable access controls for private profiles and may monitor, watermark, or restrict their use. However, no technical control can guarantee that an authorized recipient will never take a screenshot or misuse information. VirtuPinoy will address reported misuse under the additional terms presented to and accepted by the Client and under its legal rights.

6. Matching, Scoring, and Profiling

I understand that approved profile information may be compared with client job requirements using rules, automated processing, or artificial intelligence. The analysis may consider skills, experience, industry, tools, schedule, time zone, education, certifications, language, equipment, and approved role-fit indicators.

The system may generate a percentage, match category, strengths, gaps, ranking, or recommendation. These outputs are decision-support tools and are not intended to be the sole basis for a final hiring decision. Human review, interviews, verification, my continued availability, and contractual steps remain part of the process.

I may request access to or correction of my profile data and may raise a concern about matching by contacting privacy@virtupinoy.com or support@virtupinoy.com.

7. Editing and Approval

I may preview the client-facing profile and propose corrections or updates. I understand that:

• proposed changes will be saved as Pending Approval and will not become client-visible until approved;
• the last approved version will remain visible until changes are approved;
• VirtuPinoy may request supporting evidence;
• VirtuPinoy may approve all, approve selected fields, reject, or request revision;
• VirtuPinoy may standardize formatting, categories, and wording without materially misrepresenting me;
• I remain responsible for the accuracy of the underlying information.

I will submit client safe documents and media for profile display. I will remove private email addresses, phone numbers, home addresses, government identifiers, payment details, credentials, and external contact links intended to bypass VirtuPinoy. I will not include another person’s confidential information or work samples that I am not authorized to share. VirtuPinoy may request a revised file, restrict a link or withhold publication where necessary to protect privacy, confidentiality or the approved recruitment process.

8. Duration

This consent begins when I affirmatively accept it and continues while my approved profile is active, unless I withdraw it or VirtuPinoy deactivates the profile.

VirtuPinoy may retain a limited record of:

• the consent version and date;
• information previously shown;
• client presentations, shortlists, interviews, or decisions;
• contracts, payments, disputes, security events, and legal records;

after display ends, only for as long as necessary under the Privacy Policy section 10 retention schedule, applicable lawful purposes and any documented hold. Ordinary profile information may be retained while the account is active and generally for up to 2 years after account closure or termination, unless a longer period is necessary for contract administration, payments, fraud prevention, complaints, disputes, legal claims, regulation, tax or accounting. Information no longer necessary will be securely deleted or anonymized.

Withdrawing profile display consent stops future display as provided in this consent; it does not by itself close my account, restart a retention period or require deletion of records still lawfully needed for an existing engagement, payment or claim. Financial records follow the at-least-5-year period in the Privacy Policy, while consent and acceptance evidence follow their separate necessity-based criteria. A hold will preserve only relevant information until the matter is resolved and required legal retention expires.

9. Withdrawal

I may withdraw consent for future client-facing display by:

• emailing privacy@virtupinoy.com with the subject “Withdraw Profile Display Consent.”

Withdrawal will take effect within five business days after identity verification, subject to technical processing. Withdrawal:

• does not affect processing already lawfully completed;
• may not remove information already included in an active contract or record that must be retained;
• may not require a Client to delete information it must retain by law, although VirtuPinoy will instruct the Client to stop using the profile for new evaluation where appropriate;
• will generally prevent VirtuPinoy from presenting me for new opportunities requiring profile display;
• may result in talent-pool deactivation without ending an already active assignment, which is governed by the Contractor Agreement.

10. Voluntary Choice

I understand that profile display is voluntary as a matter of consent, but it is operationally necessary if I want VirtuPinoy to present my profile through this platform. I may ask whether an alternative recruitment process is available, but VirtuPinoy is not required to offer an alternative that is impracticable or inconsistent with client needs.

Public website promotion consent, marketing consent, testimonial consent, public social-media use, and background-check consent are separate and are not included here unless expressly selected in another form. This profile display consent does not authorize Tracker screenshots, work activity collection or other engagement monitoring. Any such processing must be explained separately in the applicable Tracker notice, Privacy Policy and engagement documents, with its appropriate lawful basis and any separate consent required by law. Optional marketing requires a separate voluntary opt-in with an unchecked checkbox. Refusing or withdrawing marketing consent does not prevent account, application, contract, payment, security or support communications. VirtuPinoy will record that separate choice and honor withdrawal as described in Privacy Policy section 14.

11. My Confirmation

By checking the required consent box in the VirtuPinoy portal or another approved electronic workflow, I confirm that:

• I have read and understood this consent and the Privacy Policy;
• I had the opportunity to ask questions;
• the information I submit is accurate and mine to share;
• I give specific consent to the selected client-facing uses above;
• I understand automated matching and human review may occur;
• I know how to request correction or withdraw future display.

Electronic Acceptance

Required consent statement:

I consent to VirtuPinoy displaying the categories of my approved professional profile, documents, and media that I select in the consent workflow to approved business clients for candidate evaluation, matching, interviews, and engagement opportunities, as described in this Contractor Profile Display Consent.

VirtuPinoy will maintain a record of my user ID, consent name, version number, effective date, date and time accepted, acceptance method, version accepted, selected categories, later changes and any withdrawal. The record will include a permanent copy or immutable reference to the version I accepted. An IP address may be included only if collected and appropriate. The historical version I accepted will never be overwritten by a later version.

If a change materially expands the information displayed, purposes of display or recipients covered by this consent, VirtuPinoy will notify me and obtain renewed specific consent before relying on the expanded permission. Mere continued account use or publication of a new policy does not supply that consent. Minor corrections or explanations that do not change my rights or selected uses ordinarily require notice only where appropriate, unless applicable law requires renewed consent. New marketing or monitoring choices remain separate.
